چکیده مقاله
As artificial intelligence systems increasingly generate intellectual content from artworks to inventions without human authorship or direct intent, the classical concept of 'right' is placed under unprecedented philosophical pressure Traditionally tied to human consciousness, agency, and intentionality, the notion of 'right' must now confront entities that may not possess these traits but still produce meaningful, impactful, and even creative outputs This paper explores the philosophical and legal foundations of 'right' in both Western and Islamic traditions and interrogates whether our current human centric definitions can withstand the emergence of advanced AI systems In particular, it addresses two critical issues: ۱ What new conceptualization of right could be suitable for a future in which artificial agents exhibit increasing levels of autonomy or even proto consciousness ۲ Can such a definition be universal and stable, or will it require continuous revision as new forms of agency evolve Simultaneously, this paper warns against the ethical and legal risks of neglecting human intellectual rights in the face of AI capabilities When AI systems replicate, remix, or imitate human work without consent, they pose a structural threat to the dignity, creativity, and legal protections of human beings The paper proposes a dynamic and layered theory of right not as a static entitlement, but as a relational structure of power, contribution, and agency capable of accommodating both current and future legal subjects It suggests that rights must be grounded not solely in essence such as being human but also in participation, responsibility, and the ontological nature of the subject in question
