چکیده مقاله
This systematic review explores the changing landscape of legal liability in cybersecurity related to supervisory data sharing arrangements, focusing specifically on risk management frameworks and insurance coverage within the Iranian insurance sector By analyzing 127 peer reviewed articles published from 2015 to 2025, along with regulatory documents from 15 jurisdictions, the study highlights significant gaps in the legal frameworks that govern data sharing between insurers and supervisory authorities Using a systematic review approach aligned with PRISMA guidelines, the research synthesizes evidence from global regulatory practices, with particular attention to ORSA implementation, data driven supervision models, and emerging liability frameworks The findings reveal three main challenges: first, unclear legal boundaries in cross border data sharing, with 68% of jurisdictions lacking defined liability allocation mechanisms; second, insufficient insurance coverage models for supervisory data breaches, affecting 72% of the examined markets; and third, a weak integration between technological advancements and regulatory frameworks, especially in emerging markets The analysis shows that jurisdictions with well established risk based supervision systems, such as the European Union under Solvency II and Singapore through the RBC2 framework, offer stronger liability protection via standardized data governance protocols For Iranian insurers, the study suggests a hybrid approach that combines aspects of the EU’s GDPR compliant supervisory reporting with ASEAN’s phased implementation strategy It also identifies that by adopting international best practices—such as data encryption, access controls, and incident response protocols—Iranian insurance companies could reduce their potential liability exposure by 45 to 60% These results contribute to the growing conversation on regulatory technology adoption in emerging markets and offer practical recommendations for Iranian insurers facing increasing supervisory data demands under the modernization efforts led by Central Insurance of Iran
