چکیده مقاله
Environmental crises resulting from the widespread consumption of fossil fuels, especially climate change, air pollution, and ecosystem destruction, have led the global community to reconsider the legal and political system of energy Renewable energies such as solar, wind, biomass, geothermal, and hydropower, as sustainable and low risk alternatives to fossil fuels, are not only a means to reduce greenhouse gas emissions, but also provide a platform for achieving energy justice and sustainable development at the international level However, the widespread use of these resources requires profound changes in international legal documents and treaties, especially in the fields of environmental law and energy law This research aims to analyze the additional legal changes for the use of renewable energy instead of fossil fuels from an international perspective In this regard, first, the theoretical foundations and principles of international law related to environmental protection and energy management are examined Then, important legal developments, including the UNFCCC, the Kyoto Protocol, the 2015 Paris Agreement and related documents, are analyzed, and the position of renewable energies in these systems is explained In addition, structural and legal challenges such as the lack of binding obligations, conflicting economic interests of governments, and the lack of effective mechanisms for technology transfer and investment in developing countries will be examined The research method in this article is based on descriptive analytical analysis, and the sources used include international documents, reputable scientific articles, and comparative studies The research findings show that realizing the energy transition from fossil fuels to renewable sources requires amending and incorporating legal regulations at the international level; so that principles such as “common but differentiated responsibilities” CBDR , “the right to sustainable development”, “intergenerational justice” and “technology transfer” are effectively reflected in future treaties Finally, it is proposed that a new supplementary framework be developed in the form of a protocol or annexes to the Paris Agreement to require countries to obtain a certain share of their energy from renewable sources
