The dangerous state of criminals; as the talent, capacity or potential force of an individual to cause social harm, is always considered one of the most challenging topics in criminology A dangerous state is a condition in an individual that promises the possibility of committing a crime in the future From the perspective of criminologists, if an individual's state is observed that makes it possible for him to commit a criminal act, one should intervene immediately and prevent the possibility of any damage to individuals or society by controlling and treating the individual before the crime occurs The purpose of this research is to bring the views of criminal lawyers, criminologists, sociologists and criminal psychologists closer to the approach of the Islamic Penal Code of 1392 towards criminals with a dangerous state; challenges and solutions, so that by accurately determining the level of danger of such criminals and the challenges ahead; instead of punishing such individuals, security measures and measures commensurate with the level of danger of the perpetrator can be used in order to eliminate his danger to individuals or society To achieve this goal, the descriptive analytical research method has been used, in such a way that by referring to written sources, initially about the dangerous state, with the sources available in criminal law, criminology, sociology and criminal psychology, information has been collected; then it has been analyzed with a logical method and rational reasoning The findings of the research indicate that; According to the majority of criminologists, committing a crime is caused by mental disorders, brain injuries, mental, personality and intelligence problems of individuals, in this regard, all criminals go through a critical state before committing a crime This state; is a dangerous state that occurs before the crime and at the decision making stage The result is that; society should take care and support of people who, due to a specific behavioral state, are feared to commit antisocial acts, as soon as they encounter them, even if they have not
